Terms and Conditions: This Resort or Hotel Certificate(s) (“Certificate” or “Certificates”) is valid for one 7-Night Resort Stay Holiday (“Resort Holiday”) or one 3-Night Hotel Stay Holiday (“Hotel Holiday”). And is redeemable for up to seven (7) consecutive nights, or less. Resort Holiday accommodations may include hotel type room, studio, one-bedroom, two-bedroom, or three-bedroom units at select properties and destinations and are subject to availability. Or, in the alternative, this Certificate is valid for one (1), three (3) consecutive night, or less; Hotel Holiday valid for accommodations at select destinations and hotel properties, except that for accommodations in New York City, this Certificate is valid only for two (2) consecutive nights, or less. Hotel Holiday reservations and accommodations will include a hotel room and are subject to availability. Airfare is not included. This Certificate is valid for one (1) redemption use only. Redemption of Certificate for the Hotel Holiday voids the Resort Holiday. All Resort Holiday and Hotel Holiday properties and destinations are subject to availability, seasonality, and room type restrictions. This Certificate must be booked by expiration date printed on received materials. Certificate must be used to take advantage of this offer. In addition to these Terms and Conditions, Redeemer and any Guests must also comply with the RCI terms of membership and all applicable terms and conditions, policies and procedures of the resort/hotel. It is your sole responsibility to inform your Guests of the contents of these Terms and Conditions.

This Certificate may not be combined with any other offer relating to the same reservation or accommodations. This Certificate is provided and administered by ICE Europe Ltd., trading as Our Holiday Centre (“ICE”), a company incorporated in England with company number 3793955 and whose registered office is at The Atrium, 1 Harefield Road, Uxbridge, England, UB8 1EX. Your contract in relation to this Certificate is with ICE.

You have the right to cancel your purchase of the Certificate within a period of fourteen days of the date of receipt of the Certificate (“Cancellation Period”) by giving written notice to ICE at the address set out above. After expiration of the Cancellation Period, the purchase of the Certificate is final and the entire purchase price is non-refundable. Customer acknowledgment of the non-refundable purchase price is recorded during the sales validation process. If you redeem the Certificate within the Cancellation Period, subject to receipt of the Certificate, your cancellation rights will terminate on the date of redemption. This Certificate is valid for redemption and check-in when payment for the purchase price including any applicable fees and taxes has been receive by ICE in full.

To redeem this Certificate and make a reservation (“Reservation”) follow the directions on the front of this Certificate. Reservations must be confirmed in advance of travel with ICE and you must present evidence of confirmation (the “Booking Confirmation”) to be honoured at the resort/hotel. It is important that you do not leave for your holiday until you have received the Booking Confirmation from ICE. The Booking Confirmation will be sent to you within two (2) weeks of the booking date. The Booking Confirmation may only be used by the person(s) listed on the Reservation. All confirmations are final and non-refundable. No changes may be made after confirmation.

Destinations and travel times are subject to availability and are confirmed on a first come, first served basis. Available resorts/ hotels subject to change without notice. Offer includes only accommodations and specifically excludes taxes, travel costs and other expenses that may be incurred such as personal expenses, security deposits, and other fees and charges levied by the resort/hotel. ICE is not responsible for any such expenses. Any personal taxes associated with the redemption of the Certificate are the responsibility of the Redeemer. Redeemer is responsible for all acts or omissions of Redeemer and/or Guests and for any damages caused or expenses incurred by Redeemer and/ or Guests. Other restrictions may apply. Some Mexican resorts/hotels require that an all-inclusive fee be paid.

All travellers must have in their possession proper documentation required by the country visited. Names on the Booking Confirmation must match the documentation exactly. Travelers are advised to consult with the appropriate government agencies and embassies to determine what documentation will be required. ICE assumes no responsibility for advising travellers of immigration and/ or customs requirements and/or visa requirements. The Certificate is not redeemable for cash or resale and cannot be cancelled or exchanged for refund except as required by law or as set out herein. This Certificate expires on the expiration date printed on your purchase receipt (also accessible online at www.RCICruiser.co.uk). Offer only valid to purchasers and redeemers where not otherwise prohibited by law and not valid for sponsors or distributors.

Unredeemed or expired Certificates have no value. Neither RCI or ICE is responsible for lost or stolen certificates. Lost or stolen Certificate(s) may be replaced at ICE’s sole discretion as it may determine. If ICE elects to replace a lost or stolen Certificate, processing fees may apply. Photocopies of Certificate or other reproductions will not be honoured. The Certificate may be transferred as a gift, or without payment or consideration, but cannot be used for any commercial purpose, including rental or sale.

The Certificate is void if resold for cash or other consideration. Your Guests and/or recipients of the Certificate are referred to herein as “Guest(s)”. In the event the booking is used by Guest(s) only, and not the Redeemer, additional charges by ICE and/or the resort/ hotel may apply. Redeemer is responsible for all acts or omissions of Redeemer and/or Guests and for any damages caused or expenses incurred by Redeemer and/or Guests. Neither RCI or ICE assume any liability or responsibility for any loss whatsoever to persons or property at any resort/hotel or on any aircraft/ ship in transit to and from said resort/hotel or any loss due to events outside of their control including without limitation delays, cancellations, extreme weather, storms, fire, illness, mechanical breakdown, strikes, civil unrest, terrorism or act of God.

Ice does not control the resort/ hotel and are not responsible for the resorts/ hotels actions or inactions including, without limitation, performance, lack of availability, of products and services. If you, your family or guests should incur loss or damage through use of this certificate (whether directly or indirectly), ice’s liability shall be limited to the fees paid to ice to acquire the certificate and in no event shall ice be liable for consequential, incidential, punitive, or indirect damages (including, but not limited to, lost profits or lost savings), arising from, relating to, or in connection with the use or inability to use this certificate even if ice has been advised of the possibility or could have foreseen such damages. This limitation applies regardless of form of action (whether in contract, tort, or otherwise). Provided that nothing in these terms and conditions excludes or limits the liability of ice for death or personal injury caused by their negligence.

Use of Accommodations: Redeemer must be 21 years of age or older. Guests under the age of 21 must be accompanied by parent, relative or guardian age 25 or older. Certain other age restrictions may apply. You, your family and Guests must use the confirmed accommodations in a responsible and careful manner. You are responsible for injury, damage, theft or loss caused by you, your family and Guests on the premises or facilities of the resort/hotel. You, your family and guests must comply with all rules and requirements of the resort/hotel including arrival and departure times. You must present a Booking Confirmation from ICE to the resort / hotel at check-in. Maximum unit occupancy restriction set by resort hotel must be observed. Information provided by ICE or its affiliates and licensors about resort/hotel accommodations is based upon information obtained from resort/hotel management and its affiliates.

These Terms and Conditions are subject to change at the discretion of ICE and without prior notice to you, provided that no such change will adversely affect your rights as set out in these Terms and Conditions unless notified to you in advance. If you have any questions, queries or complaints in connection with the Certificate, please contact ICE at the address provided above or by calling the phone number on your Certificate. By accepting and using this Certificate, you agree to be bound by these Terms and Conditions. These Terms and Conditions will be governed by and construed under the laws of England. Any action at law or in equity by you or your Guest, who is either on holiday with you or traveling with you under a Booking Confirmation, to seek any remedy against ICE, their associated entities, designees, or contractors must be submitted exclusively to the jurisdiction of the courts of England.
