Experience Pass Certificate Terms and Conditions:
You (“You” or “Your”) have received an Experience Pass Certificate (“Experience Pass”) in conjunction with your purchase of a RCI Cruise and Resort Holiday Package.
These terms and conditions (the “Terms and Conditions”) govern the use and redemption of the Experience Pass by each member who has received an Experience Pass and has right to redeem it towards the purchase of tours, guided holidays and more. It must be redeemed within 12 months of issuance and may only be used one time. These Terms and Conditions, the Experience Terms and Conditions including, without limitation, the cancellation policy for cash purchases, the terms and conditions of membership and all applicable cruise line and third-party travel supplier terms and conditions and policies and procedures apply to the Experience Pass.
It is your sole responsibility as the RCI Cruise and Resort Holiday package holder to comply with and inform your guests of these Terms and Conditions, as well as the terms and conditions and policies and procedures of all applicable cruise lines. The Experience Pass is only available to package holder and is not transferable to any other party.
Experience pass
The Experience Pass received with a qualifying RCI Cruise and Resort Holiday Purchase provides members in good standing with the opportunity to purchase Experience’s at the discounted rates with available savings between £500 and £1200 per couple, without (I) payment of an additional Exchange or Transaction Fee, and (ii) without an exchange of a qualified Deposit or applicable Points for a period of twelve (12) months following the date of your Qualifying RCI Cruise and Resort Holiday package Purchase.
Subject to the exceptions below, the Experience Pass received through a qualified RCI Cruise and Resort Holiday Purchase will be issued within your qualifying RCI Cruise and Resort Holiday Purchase, and will expire twelve (12) months from the date of your qualifying Purchase. Your Experience must be booked within twelve (12) months from the date of your qualifying RCI Cruise and Resort Holiday Purchase and travel must be completed within twelve (12) months from the date of purchase.
Unredeemed Experience pass
An unredeemed Experience Pass has no value. RCI and ICE are not responsible for lost or stolen Experience Passes. Lost or stolen Experience Passes may be replaced at Holiday Package and ICE’s sole discretion as they may determine. If RCI or ICE elects to replace a lost or stolen Cruise Pass, processing fees may apply. Photocopies of the Experience Pass or other reproductions will not be honoured. The Experience Pass may not be used for any commercial purpose, including rental or sale. In the event ICE learns of such Experience pass being used for commercial purposes, ICE may immediately terminate your rights under the Experience Pass including any pending travel thereunder.
Cancellation of Experience pass
If you have received an Experience Pass in conjunction with a qualifying RCI Cruise and Resort Holiday Package Purchase, cancellation of such qualifying RCI Cruise and Resort Holiday Package Purchase voids the Experience Pass.
ICE reserves the right in its sole discretion to modify the Cruise Pass or to restrict its availability at any time, for any or no reason, and without prior notice or liability to you.
Experience Pass Redemption
To redeem the Experience Pass, call 0800 032 0978 or follow the directions contained within the Cruise Pass. Reservations must be confirmed by RCI Cruise and Resort Holiday (“Booking Confirmation/Cruise/Resort Receipt”) to be honoured at the Tour/Experience. Do not leave for holiday until you have received the confirmation or Booking Receipt.
Fulfilment Services
The issuance and redemption of the Experience Pass and the Experiences offered or purchased through RCI Cruise and Resort Holiday are administered by ICE Europe Ltd., trading as Our Holiday Centre (herein as “ICE” and “OHC”), a company incorporated in England with company number 3793955 and whose registered office is at The Atrium, 1 Harefield Road, Uxbridge, England, UB8 1EX. RCI disclaims all responsibility in connection with any third-party cruise or travel services.
Force Majeure
RCI and ICE do not assume any liability or responsibility for damage, expense, inconvenience, loss, injury, death or damage to persons or property on any cruise line ship or on any aircraft/ship in transit to and from said cruise line ship, or for any cause whatsoever due to delays, cancellations due to nature, oil spill, mechanical breakdown, strikes, civil unrest, terrorism (or threat of terrorism) or acts of God.
Limitation of Liability
RCI AND/OR ICE SHALL NOT BE LIABLE FOR AND DOES NOT ASSUME ANY LIABILITY OR RESPONSIBILITY FOR ANY LOSS, DAMAGE, DELAY, DEATH OR INJURY TO PERSON OR PROPERTY ARISING FROM OR AS A RESULT OF THE ACTS OR OMISSIONS AND/OR REPRESENTATIONS (WHETHER ORAL OR WRITTEN) OF THE CRUISE LINE OR OTHER TRAVEL SUPPLIERS, REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT INCLUDING NEGLIGENCE, STRICT LIABILITY OR OTHERWISE. RCI'S AND/OR ICE’s LIABILITY FOR ANY CLAIM ARISING FROM OR AS A RESULT OF THE ACTS OR OMISSIONS AND/OR REPRESENTATIONS (WHETHER ORAL OR WRITTEN) OF RCI WILL BE LIMITED TO THE PORTION OF FEES PAID BY YOU AND HELF BY RCI AND/OR ICE, IF ANY, FOR THE CRUISE. IN NO EVENT WILL RCI AND/OR ICE BE LIABLE FOR SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES EVEN IF NOTIFIED OF THE POSSIBILITY OF SAME. THIS LIMITATION SHALL ALSO APPLY TO RCI AFFILIATED COMPANIES, SUCCESSORS, ASSIGNS AND AGENTS OF RCI.
Governing Law
These Terms and Conditions will be governed by and construed in accordance with the laws of England and Wales. The parties irrevocably consent to the jurisdiction of England and Wales for the resolution of any disputes or conflicts arising out of or related to these Terms and Conditions.
RCI Travel is fulfilled by Contemporary Travel Solutions. RCI Travel does not supply any travel services and is not responsible for any of the products or services offered herein. Contemporary Travel Solutions is an Accredited Body member of Advantage Travel Centres ("Advantage"), company registration number 04698963, ABTA Number P6913. Advantage Travel Centres has its registered office at 21 Provost Street London N1 7NH. This means you have the benefit of ABTA's assistance and Code of Conduct. All the flights and flight-inclusive holidays are financially protected by the ATOL scheme. When you pay you will be supplied with an ATOL Certificate. Please ask for it and check to ensure that everything you booked (flights, hotels and other services) is listed on it. In the unlikely event of insolvency, the CAA will ensure you are not stranded abroad and will arrange to refund any money paid for an advance booking.
